Terms of Service

1. Service nature. MarsAI is an API routing layer. All model responses are produced by third-party upstream providers. We do not own, host, or control the underlying models.

2. Upstream dependency. Availability, quality, speed, context limits, and pricing of every model depend entirely on upstream providers. If an upstream is down, degraded, rate-limited, deprecated, or removed, the affected model may fail or disappear without notice. Our only obligation in that case is to announce the disruption on Discord and/or the dashboard. No refunds, credits, compensation, credit increases, or service credits are owed for upstream outages, deprecations, quality changes, or price changes.

3. No SLA. The service is provided strictly "as is" and "as available" with no uptime, latency, accuracy, or fitness guarantee of any kind.

4. Payments & credits. Premium Credit purchases, redeem codes, grants, referrals and check-in rewards are final and non-refundable once credited. Credits expire per plan validity. Unused credits hold no cash value and are never redeemable for money.

5. Acceptable use. No illegal content, abuse, spam, scraping at scale, resale or sublicensing without written permission, bypassing limits, or probing upstreams. Violation = immediate termination without refund.

6. Pricing changes. Per-model usage ratios and USD prices may change at any time to reflect upstream costs. Published pricing at request time applies.

7. Liability cap. To the maximum extent permitted by law, total liability is limited to the unused paid balance in your account. No liability for lost profits, data, or business interruption.

8. Termination. We may suspend or terminate accounts for abuse, fraud, chargebacks, or ToS violation, with forfeit of unpaid balances and referral rewards.

9. Changes. Terms may be updated at any time; continued use after notice constitutes acceptance.
